I don't think any superhero film can ever be pure solid gold 10/10, because there's always a little bit of inherent silliness of a bloke with a silly name in tights and/or a cape - that said, a lot of the Batman, Spider-Man, X-Men etc films have done a very good job of (almost) getting over that.
Plus they always have to waste of lot of time on the origin of the hero and/or villains, which doesn't help (although in the case of Captain America, the origin bit was the best part, then the rest of the plot fell a bit flat). It would be quite nice if someone was brave enough to make a superhero film where they just assumed the audience already knew the back-story!
Anyway, I have to wait until 19 August to see The Dark Knight Rises at the IMAX. Everyone else in the world will have seen it and analysed it to death by then....
