RHCP rip off Tom Petty?
« on: May 27, 2006, 06:17:04 PM »
Any body seen the article about 'Dani California' sounding extremely like an old Tom petty track 'Last dance with Mary Jane', http://www.ultimate-guitar.com/news/general_music_news/red_hot_chili_peppers_accused_in_plagiarism.html
Must admit it  is VERY similar :o

yea heard about that, i think it is the same, no doubt. Ive shown other people who disagreed and some agreed.

Although, it is only 4 chords. Maybe the chillis just stumbled across that rhythm or is it just too similar to be a concidence?

Yeah, a lot of songs share the same chords, but that's a pretty damn close match.  It wouldn't be the first time that one band has ripped off another, for sure.

For the record I prefer the Tom Petty version.  Never heard it before.

i seriously doubt they just deliberately copied it, but a melody or rhythm can stick in your subconcious and 15 years later you end up using it without even realising.

i recorded an entire album, then realised it was an almost note for note recreation of appetite for destruction...

The thing about this song is that rhythm, that's what gets me. Now, bear in mind 3 things:

1)Rick Rubin is a pretty 'hands-on' producer; we see him in the 'Funky Monks' film suggesting bassline rhythms to th Flea, for instance.

2)Rick Rubin produced both songs -The Chilis & Tom Petty.

3) The Chili's have produced demos of songs before that have appeared significantly different to the final product (i.e. 'Fortune Faded')

Putting all this together, I don't find it inconceivable that RHCP had that song and that sequence, and Rubin asked them to emphasise it in that manner.

Regarding the lyrics, Rubin has suggested lyrical themes for Keidis before ('The Greeting Song' on Bloodsugarsexmagik).

So, I think it might be a coincedence, but fuelled by some unimagination on the part of Rubin.
The large print giveth, and the small print taketh away...

:D It`s a rip off !!

The question isn`t wether it`s a ripp off but wether it`s intentional. i have to say that the rythem of the song is very chilli peppers, sounds like some of the stuff they`ve done before, so if you pick the right or wrong chord progression then your going to get close. If the producer recorded both artists then there`s your answer.

Tom Petty is cool  8) his "Full Moon Fever" album is one of the greatest albums ever recorded

has anyone ever heard a song on the radio or TV, and then weeks, months, years later, played something on the guitar, that sounds familiar to you, but yu don't know what it is...
Then you're playing it one day and someone's like OH! thats that song by that guy... and you're like no! i wrote this :?

It does sound very much like a lift- it is a question of whether it was deliberate. The chord sequence is not that rare and the melody line is generic- but the same key!. Plagarism can be innocent- I know I have done it without realising until finishing a recording and that was only one section of a song. I was horrified when some smart arse pointed it out- scr@pped it and wrote a new section and it ended up better!

Well, I'd say if Petty goes to court he's got very good chances to win, as the evidence is really strong - no matter if deliberate or not, they'll have to pay.

Dany California is definitely closer to the Petty song than the Singlecut to the Les Paul:)

I noticed it when I first heard Dani. Striking resemblance. Even Keidis his voice and intonation sound similar.

its gotta be one of those flukes - surely the Peppers would choose someone a little less well know if they were gonna start ripping people off.

fwiw I like Petty's song better too, actually I like Tom Petty better in general.
